This litigation, Yvonne Pope Thompson v. SafeAmerica Credit Union, alleges that defendant SafeAmerica Credit Union (“Defendant”) improperly assessed APSN Fees, Retry Fees, and Sufficient Funds Fees between November 9, 2019 and February 29, 2024. Defendant does not deny it charged the fees the class representative is complaining about, but contends it did so properly and in accordance with the terms of its agreements and applicable law. Defendant therefore denies that its practices give rise to claims for damages by the Named Plaintiff or any Class Members but is settling to avoid expense and distraction resulting from the litigation.
If you are a Class Member and if the settlement is approved, you may be entitled to receive a cash payment from the $390,000 Settlement Fund.
The Court has preliminarily approved this settlement. It will hold a Final Approval Hearing in this case on November 13, 2025 at 9:00am PT. At that hearing, the Court will consider whether to grant final approval to the settlement, and whether to approve payment from the Settlement Fund of up to $5,000 for a service award to the Named Plaintiff (Yvonne Pope Thompson), up to one-third of the Settlement Fund as attorneys’ fees ($130,000), plus reimbursement of reasonable litigation costs to the attorneys and the Settlement Administrator. You may attend the hearing with or without an attorney, at your own expense, but you do not have to. If the Court grants the Final Approval Order and you do not request to be excluded from the settlement, you will release your right to bring any claim covered by the settlement. In exchange, Defendant has agreed to issue a credit to your account or make a cash payment to you if you are no longer a member of Defendant.
